It is here that you’ll uncover an array of exclusive offering valuable insights that are accessible only to ‘Site’ members.

Ownership of Content

Members are granted a limited, non-transferable, non-sublicensable, revocable license to access and use the content solely for personal, non-commercial purposes in accordance with these Terms.

Upon joining this ‘Site’, it’s essential to understand that you won’t have access to all content available on the ‘Site’. The content released before the commencement of your subscription month remains inaccessible. However, you’ll gain the privilege of accessing all content published during your subscription year. You have the opportunity to renew your subscription for another year, thus regaining access to your existing content and continuing to receive new content for the subsequent year.

Service Availability and Disruptions

The ‘Site’ may occasionally experience disruptions due to maintenance, updates, or network issues, during which time access to content and services may be temporarily unavailable. Nomad Capitalist will make reasonable efforts to restore the ‘Site’s’ functionality as promptly as possible. During such disruptions, Members may contact their designated Nomad Capitalist Case Officer for assistance or inquiries.

Restrictions on Use

Members are strictly prohibited from:

a. Reproducing, distributing, modifying, displaying, performing, or creating derivative works based on any content on the Site without prior written authorization.

b. Sharing, reselling, or redistributing content to third parties.

c. Circumventing any content protection measures implemented on the Site.

Offline Access

Members may not download or cache content for offline use unless explicitly permitted by the ‘Site’. In cases where offline access is authorized, such content remains subject to the same restrictions on use described above.

Enforcement of Content Misuse

Any misuse of content, as determined by Nomad Capitalist in its sole discretion, may result in:

a. Immediate termination of the Member’s account and access to the ‘Site’.

b. Legal action, including but not limited to claims for damages, injunctive relief, or other appropriate remedies.

Subscription Management

Cancellation Process

Should you wish to cancel your ‘Site’ membership, including closing your account, please contact our concierge with your request. Please be aware that this decision is irreversible, and the content you currently have access to will not be recoverable. We do not provide refunds for cancelled memberships. Should you decide to re-join in the future, a new payment for a full year’s subscription will be required.

1. Acceptance of Terms

11. Indemnification

You commit to defending, indemnifying, and holding ‘Nomad Capitalist’, its affiliates, and their respective officers, directors, employees, vendors, and agents, harmless from any claims and expenses.

You agree to indemnify and hold harmless ‘Nomad Capitalist’, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms

12. Binding Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, including any disputes concerning their validity, interpretation, or enforceability (collectively referred to as “Disputes”), both you and ‘Nomad Capitalist’ agree to resolve such Disputes through binding arbitration.

Any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Hong Kong in English. The Member irrevocably agrees that the courts of Hong Kong shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Terms.

The Member acknowledges and agrees that, due to the “nomadic” international nature of Nomad’s business and its clients, these Terms, as to jurisdiction, forum, venue, and choice-of-law are proper. The Member hereby waives any and all defenses or objections to these Terms, including but not limited to any objection or defense on the grounds that the forum is not convenient, or that the jurisdiction or choice of law is otherwise not justified or reasonable.

The Member voluntarily waives the right to initiate litigation arising out of or in connection with these Terms outside of Hong Kong. The prevailing party in the arbitration shall be entitled to recover their costs, including reasonable attorney’s fees, from the other party.

12.1. Any legal claims not subject to arbitration and not initiated in small claims court will be resolved in courts of Hong Kong, and you agree to personal jurisdiction in these courts.

13. Modifications to Service

‘Nomad Capitalist’ reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. You agree that ‘Nomad Capitalist’ will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

14. Accuracy of Member Information

You affirm that all information you provide to ‘Nomad Capitalist’, whether at registration or during the course of your use of the Service, is true, accurate, and complete, and you agree to update your information as necessary to maintain its truth and accuracy.

These Terms are governed by Hong Kong laws.
