Welcome to Nomad Capitalist Clients (“Nomad Capitalist+”), our premium Membership platform designed to provide you with exclusive access to a treasure trove of valuable content and benefits. As a Nomad Capitalist+ member, you gain access to a wide array of features, including bonus reports, unseen town hall videos, strategy webinars, captivating NCL speeches, a complimentary ticket to the Nomad Capitalist Live event, and the privilege of reaching out to our concierge for inquiries about our services or the membership site. While it is our intention to launch the Nomad Capitalist Clients site on January 1st, we reserve the right to delay the launch by up to 30- days and you will receive your full 12 months of access.

Once you’ve successfully logged in with your active Member account, you’ll find your gateway to premium content in the “Articles” or “Videos” sections located in the main menu. It is here that you’ll uncover an array of exclusive articles and videos, offering valuable insights that are accessible only to Nomad Capitalist+ members.

Content Accessibility

Upon joining Nomad Capitalist+, it’s essential to understand that you won’t have access to all content available on the platform. The content released before the commencement of your subscription month remains inaccessible. However, you’ll gain the privilege of accessing all content published during your subscription year. You have the opportunity to renew your subscription for another year, thus regaining access to your existing content and continuing to receive new content for the subsequent year.

We are committed to keeping your Nomad Capitalist+ experience fresh and enlightening. To achieve this, we consistently release new exclusive content every month. This content includes a range of exclusive articles, bonus reports, and captivating videos, all created exclusively for our Nomad Capitalist+ members. This regular influx of content ensures you stay well-informed and up-to-date with the latest insights and updates.

Managing Your Account

Updating Your Account Details

Maintaining your account and personal details is a straightforward process. Simply navigate to the “Profile” section, where you’ll find a range of options to modify your name, email, password, and other relevant account details.

Subscription Management

Pause Option

At this time, we do not offer a subscription pause option. Your current subscription remains active for one year, and this period cannot be interrupted or extended. We recommend maintaining an active subscription to continuously reap the benefits of our exclusive content and member privileges.

Cancellation Process

Should you wish to cancel your Nomad Capitalist+ membership, including closing your account, please contact our concierge with your request. Please be aware that this decision is irreversible, and the content you currently have access to will not be recoverable. We do not provide refunds for canceled memberships. Should you decide to rejoin in the future, a new payment for a full year’s subscription will be required.

Payment Queries

Auto-Renewal Policy

We do not auto-renew user subscriptions, and we do not retain payment information for billing purposes. Our system operates on a one-time billing system. Therefore, once your subscription expires, you will lose access to the member area. However, you will have the option to renew your subscription if you wish to regain access to both your existing content and the new content for another year.

Payment Security

Rest assured that your payment information remains secure with us. We utilize encrypted payment gateways, and our system does not directly process or retain any billing information. This approach ensures that your payment details remain private and protected.

Billing Issues

In the rare event of a double charge or any other billing-related discrepancies, please contact our support team immediately at clients@nomadcapitalist.com, providing details of the transaction(s). We will act swiftly to address the issue and resolve it to your satisfaction.

Membership Refunds

We deeply value your membership with Nomad Capitalist+. However, please be aware that we do not offer refunds for memberships once they’ve been activated. If you experience any issues or have concerns, please do not hesitate to reach out to our concierge at clients@nomadcapitalist.com. We are here to assist and address your needs to the best of our ability. If you’ve subscribed before December 31st, 2023, and are entitled to the free Nomad Capitalist Live 2024 ticket, please keep in mind that the ticket in non-transferable and can be used only for the 2024 event.

Pro-Rated Refunds

Pro-Rated Refunds:
In certain circumstances, Nomad Capitalist may offer pro-rated refunds for subscription fees paid by users. Pro-rated refunds will be considered based on the remaining duration of the subscription period and are subject to the terms outlined herein.

Eligibility, Calculation, Termination, and Exceptions

Users may be eligible for a pro-rated refund if Nomad Capitalist decides to cancel the service and cease content production before the end of the subscription period. Pro-rated refunds will be calculated based on the remaining unused portion of the subscription period. For example, if a user subscribed for a one-year period and Nomad Capitalist decides to terminate the service after 9 months, the user may be eligible for a pro-rated refund of 25% of the original subscription fee. Nomad Capitalist reserves the right to terminate the service and cease content production at its discretion. In such cases, eligible users will be notified of the termination and the pro-rated refund process. Refunds will be issued in a timely manner. Nomad Capitalist reserves the right to exclude certain circumstances from pro-rated refunds, depending on the individual case and particular circumstances.

1. Acceptance of Terms

Welcome to “Nomad Capitalist Clients”. Your usage of the Site indicates your consent to comply with and be bound by these Membership Site Terms of Service (“Terms”). Should you disagree with these Terms, please refrain from using the Site.

2. Definitions

“Nomad Capitalist” refers to Nomad Capitalist LLC, located at 2028 E Ben White Blvd, #240-6003, Austin, TX 78741, United States.

“NCL” refers to Nomad Capitalist Live, an affiliate of Nomad Capitalist.

“Member” pertains to any person or entity registered with the Site to access the Services.

“Founding Member” pertains to any person or entity registered with the site between December 1st and 31st, 2023.

“Vendor” signifies a person or entity providing goods or services on the Site.

“Service” represents the services offered by the Site, as defined in the relative terms and on the Website.

“Terms” corresponds to these Membership Site Terms of Service.

3. Use of the Site

3.1. Eligibility

You must be at least 18 years old to use the Site. By using the Site, you affirm that you are over the age of 18.

3.2. Membership

To access certain Site features, registration and membership are required. You are responsible for safeguarding your account and password, as well as all activities under your account. Unauthorized account usage must be promptly reported to the Site.

3.2.1. You agree to maintain the confidentiality of your account login information and are responsible for all activities that occur under your account. You agree to immediately notify Nomad Capitalist Clients of any unauthorized use of your account or any other breach of security.

3.3. Vendor Services

Vendors may offer goods or services on the Site. Engagement with Vendors signifies acknowledgment and agreement that Nomad Capitalist Clients is not responsible for the quality, accuracy, or any aspect of the Vendor’s goods or services or description of the same.

4. User Conduct

4.1. Prohibited Activities

While using the Site, you commit to refraining from engaging in the following prohibited activities:

a. Violating any applicable laws or regulations.

b. Infringing upon the rights of third parties.

c. Disseminating spam, disinformation material, or unsolicited commercial messages.

d. Posting false, defamatory, inaccurate, or misleading information.

e. Engaging in disruptive conduct that interferes with the Site’s operation.

f. Attempting unauthorized access to any part of the Site.

g. Partaking in activities adversely affecting other Members’ Site usage.

4.2. Content Restrictions

You bear responsibility for the content posted on the Site. Agree not to share or post content that is:

a. Defamatory, abusive, or harassing.

b. Obscene, indecent, or offensive.

c. Infringing upon intellectual property rights.

d. Contrary to any law or regulation.

Please keep in mind that as a Founding Member of Nomad Capitalist Clients, until our official launch on January 1, you’ll only have exclusive access to our past Keynote speeches from Nomad Capitalist Live. Come January 1st, our official launch, you’ll unlock full access to all our monthly offerings. This includes 5 monthly reports, webinars, and other exclusive content we’ve curated just for you.

5. Privacy Policy

Site use is regulated by our Privacy Policy. By using the Site, you provide consent for your information’s collection, use, and sharing as stipulated in the Privacy Policy.

6. Payments

6.1. Membership Fees

Certain Site features may necessitate membership fee payments. You agree to fulfill all membership fees and related charges incurred under your account.

6.2. Vendor Payments

Payments made to Vendors on the Site are subject to the Vendor’s terms and conditions if you choose to engage with them.

7. Intellectual Property

7.1. Ownership

Nomad Capitalist Clients retains complete ownership rights to the Site, including all content, trademarks, logos, and intellectual property.

7.2. License

Nomad Capitalist Clients grants a limited, non-exclusive, revocable license for your personal, non-commercial use of the Site.

7.3. Member Use of Content

Members may use the content provided on the Site for their personal, non-commercial use only. Reproduction, distribution, display, or performance of the content is strictly prohibited unless expressly permitted by Nomad Capitalist Clients.

8. Changes to Terms

Nomad Capitalist Clients reserves the right to alter these Terms at any time. The revised Terms take effect upon posting on the Site. Continuing Site use after changes are posted constitutes acceptance of the modified Terms.

8.1. Changes to the terms will be communicated to members via email or through a prominent notice on the Site at least 30 days before the changes become effective.

9. Termination

Nomad Capitalist Clients may, at its discretion, terminate your membership or limit your Site access without notice, for any reason, including violation of these Terms.

9.1. You may terminate your account and subscription at any time by contacting our concierge service. Upon termination, your right to use the Service will immediately cease and you will lose your access and entitlement to the free Nomad Capitalist Live event ticket.

10. Information Disclaimer

Any financial, immigration, legal, or tax information provided or presented on this Site, or linked from this Site in written, audio, or video format, by any person or organization, is intended purely for entertainment and informational value. It should not, under any circumstances, be construed as professional advice. We strongly recommend that you seek independent financial, tax, and legal advice before taking any action based on the information or content provided on this Site. Nomad Capitalist, Nomad Capitalist Live, Nomad Capitalist Clients, its affiliates, employees, officers, vendors, or contributors do not assume any responsibility for the accuracy, completeness, or suitability of the information provided. 11. Disclaimer of Warranties

You acknowledge that Site use is at your own risk. The Site is provided on an “as-is” and “as-available” basis. Nomad Capitalist Clients, NCL affiliates, and vendors disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nomad Capitalist Clients, its officers, directors, employees, affiliates, agents, vendors, or third-party service providers, will not be liable for any incidental, special, punitive, or consequential damages.

Nomad Capitalist Clients is intended for entertainment value and is not a source of tax, financial, or legal advice. We connect you with vendors to DIY at your own expense, and if you need our help in creating your Plan, you can use our other services.

13. Indemnification

You commit to defending, indemnifying, and holding Nomad Capitalist Clients, its affiliates, and their respective officers, directors, employees, vendors, and agents, harmless from any claims and expenses.

13.1. You agree to indemnify and hold harmless Nomad Capitalist Clients, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

14. Binding Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, including any disputes concerning their validity, interpretation, or enforceability (collectively referred to as “Disputes”), both you and Nomad Capitalist Clients agree to resolve such Disputes through binding arbitration.

Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), including its Supplementary Procedures for Consumer-Related Disputes. The arbitration will take place in Austin, Texas, United States, and will be presided over by a single arbitrator appointed in accordance with the AAA rules. You and Nomad Capitalist Clients agree that any Dispute resolved by arbitration shall not be combined with other disputes or consolidated in any arbitration with any other person or entity’s claims or disputes. You acknowledge and agree that you are waiving your right to pursue claims in court, including the right to a jury trial. This arbitration clause will not prevent you from filing a complaint with any appropriate government agency, including the Federal Trade Commission (FTC). The prevailing party in the arbitration shall be entitled to recover their costs, including reasonable attorney’s fees, from the other party.

14.1. Any legal claims not subject to arbitration and not initiated in small claims court will be resolved in the federal or state courts of Texas, United States, and you agree to personal jurisdiction in these courts.

15. Modifications to Service

Nomad Capitalist Clients reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice at any time. You agree that Nomad Capitalist Clients will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

16. Accuracy of Member Information

You affirm that all information you provide to Nomad Capitalist Clients, whether at registration or during the course of your use of the Service, is true, accurate, and complete, and you agree to update your information as necessary to maintain its truth and accuracy.

These Terms are governed by United States laws.
